Terms and Conditions
These are the terms and conditions on which we supply the goods to you. Please read them carefully before placing an order with us. We reserve the right to modify these terms and conditions at any time. By placing an order with us, you will be deemed to have accepted these terms and conditions.
1. Definition
"We" means Crystal Battery Storage LTD (registered in England and Wales with company number 15076103).
"Contract" means the contract entered into between Crystal Battery Storage LTD and the Client.
"Customer" "Buyer" means a legal individual or corporate entity purchasing Merchandise from Crystal Battery Storage LTD.
"Item" means the item for sale (or any part thereof) listed in the Order Confirmation or displayed on the Site.
"Order" means a Customer's order for Merchandise.
"Working day" means a day (other than a Saturday, Sunday or public holiday) on which banks in London are open.
"Website" means the website at crystalbatterystorage.com
"You" means the user of the Site.
2. Access instructions
2.1 You are responsible for ensuring that your equipment (computer, laptop, netbook, tablet or other mobile device) meets all necessary technical specifications to enable you to access and use the site and is compatible with it.
2.2 You must ensure that any registration details you provide are accurate.
2.3 You are responsible for all activities that occur under your login ID and must immediately notify us of any unauthorized use or other breach of security that you become aware of.
2.4 From time to time, we may restrict registered users' access to certain features, parts or content of the site or the site as a whole.
2.5 We cannot guarantee continuous, uninterrupted or error-free operation of the website. From time to time, certain features, parts or content of this website or the entire website may become unavailable, or be modified, suspended or withdrawn at our sole discretion without notice.
2.6 You will not use this website and any content provided on this website in a manner that may damage our name or reputation or that of any of our affiliated companies, and only in a responsible manner for lawful purposes (complying with all applicable laws and regulations).
2.7 Whilst we endeavor to ensure that all information contained on the website (other than any user generated content) is correct, it does not constitute authority or advice on which reliance should be placed. You should check with us or the relevant source of information before acting on any such information.
3. Quotes and orders
3.1 Our offers for goods are only valid for 14 days from the date of their publication.
3.2 You may submit a complete purchase order by telephone, email or our website.
3.3 All orders are subject to our acceptance, and for the avoidance of doubt, processing your payment or confirming your order (including sending an email confirming that your order is being processed) does not constitute a legal acceptance of your order.
3.4 If for any reason we are unable or unwilling to accept your order, we will notify you and you will not be charged for the goods. If payment has already been made, we will refund the money to you. In such event, we will not be liable to you or anyone else.
4. Payment method
4.1 Unless you have credit terms with us, all orders must be paid in full before dispatch.
4.2 We accept payment by bank transfer, online debit card, PayPal and credit card.
4.3 Prices and shipping charges are subject to change at any time, but changes will not affect orders for which we have sent you an order confirmation.
5. Delivery and receipt
5.1 Although we choose which courier companies we use and only work with those that provide reliable service, we do not guarantee on-time or next-day delivery.
5.2 We are not liable for any further costs incurred as a result of a failed delivery. It is the buyer's responsibility to ensure that someone is at the address given to receive, inspect and sign for the shipment, any attempted but failed deliveries will be charged. It is the buyer's responsibility to inform us of any access restrictions to the delivery address prior to dispatch of the order. These will also be charged in full if the address or date is incorrect and re-delivery is required.
5.3 Your order will be delivered to the delivery address within the UK specified by you when placing your order. If your delivery address is geographically remote, such as certain outlying islands or other remote areas, we may not be able to deliver there. If this is the case, we will notify you before accepting your order. We reserve the right not to deliver to any country prohibited by applicable export laws.
5.4 After receiving the order, please check the contents immediately. Please pay attention to whether the packaging or the goods are damaged when signing for receipt. While breakage in transit is rare, it can happen. You should check the contents against the packing list or quotation you received and report any missing or damaged items to us by phone or email within two business days.
5.5 Crystal Battery Storage LTD will refund or replace any merchandise that arrives damaged and will send a replacement as soon as possible subject to stock availability, but will not be responsible for any further costs incurred as a result of the arrival of the damaged merchandise on site. Delayed deliveries and shipping damages occur occasionally and may affect installations scheduled for the day of delivery. Crystal Battery Storage LTD will work closely with customers to resolve issues as quickly and cost-effectively as possible, however our financial liability for delays, errors and damage in shipping is strictly limited to the value of the order itself, including delivery.
6. Risk and Ownership
6.1 From delivery or collection (as the case may be), the products ordered are at your own risk. Title to the Products ordered will also pass to you upon delivery or collection (as the case may be).
6.2 If you arrange the transportation/shipment of the goods yourself, the risk of the goods will pass immediately when the goods come into your physical possession, which includes (but is not limited to) the goods are loaded into your or your agent's conveyance.
6.3 Title to the merchandise will not pass to you until we have received full payment (cash or cleared funds) for the merchandise and any other goods or services we have provided to you.
7. Design and Direction
7.1 While we are happy to provide guidance, the design of photovoltaic and battery storage systems remains solely your responsibility.
7.2 We use our best endeavors to ensure that the information and documents on our website are accurate and up to date. Crystal Battery Storage LTD accepts no responsibility if anything in this information or documentation is incorrect or out of date and it is ultimately the buyer/customer's responsibility to ensure they are satisfied with the product and system design prior to purchase.
8. Information
We strive to keep the information on our website accurate and up to date and aim to complete orders in a timely manner to the complete satisfaction of our customers. However, we reserve the right, in our sole discretion, to refuse orders, to change the prices and specifications of items listed on the site, and to discontinue sale of items at any time.
9. Warranty
9.1 All goods are supplied by Crystal Battery Storage LTD and are subject to the relevant manufacturer's warranty on the relevant goods (Crystal Battery Storage LTD can provide a copy of this if requested by the customer).
9.2 In the event of any defect or malfunction of the goods or any other issues relating to the goods, customers can contact Crystal Battery Storage LTD directly and state the problem clearly. After that, Crystal Battery Storage LTD will be responsible for contacting the supplier, helping the customer deal with it, and striving to provide the customer with the best solution.
9.3 If the goods are sold with a manufacturer's guarantee, we will pass on the benefit of the guarantee (or similar) to you. It is your responsibility to follow any registration procedures prescribed by the manufacturer for warranty (or similar). Any complaints, inquiries or claims under a manufacturer's warranty (or similar) must be directed to the manufacturer and we disclaim any responsibility or liability under or in connection with any such warranty (or similar).
10. Limitation of Liability
10.1 If you are purchasing goods and/or using our design services as a commercial customer, then to the fullest extent permitted by law, all warranties, conditions and other terms implied by statute or common law are excluded from this agreement.
10.2 If you purchase goods and/or use our design services as a commercial customer, we shall not be liable to you under paragraph 10.1 above, whether in contract, tort (including negligence), breach of statutory duty or otherwise, any loss of profits, business, revenue, capital, anticipated savings and/or goodwill or any indirect or consequential loss arising under or in connection with any contract between us.
10.3 If you purchase goods and/or use our design services as a consumer, to the extent not prohibited by law, we shall not be liable for the following situations: unforeseen losses; losses not caused by our fault or breach of contract; business losses (including loss of profits, loss of business, loss of contracts, loss of goodwill, loss of business opportunity and other similar losses, and business interruption).
11. Force majeure
11.1. Neither party shall be liable for any failure or delay in performance of its obligations under this Agreement due to force majeure events.
11.2. Force Majeure Event means any event beyond a party's reasonable control which by its nature could not have been foreseen or, if foreseeable, was unavoidable, including strikes, lockouts or other industrial disputes (whether involving its own workforce or third parties), failure of energy or transportation networks, force majeure, war, terrorism, riots, civil strife, interference by civil or military authorities, national or international disasters, armed conflict, malicious sabotage, failure of plant or equipment mechanical, nuclear, chemical or biological contamination, sonic boom , explosion, collapse of building structures, fire, flood, storm, earthquake, loss at sea, epidemic or similar event, natural disaster or extreme weather conditions, or default by suppliers or subcontractors.
